Privacy Policy

This Privacy Policy explains how AquaPerfectSXM (“we”, “us” or “our”) collects, uses, shares and protects personal information about you when you visit our website, request a quote, book a service or otherwise interact with us.

For the purposes of the National Ordinance on Personal Data Protection (Landsverordening bescherming persoonsgegevens, AB 2010, GT no. 9) of Sint Maarten — and, where applicable, Regulation (EU) 2016/679 (“GDPR”) for individuals located in the European Union — we are the controller of the personal data described below.

This Privacy Policy applies to:

• Visitors of our public website at https://aquaperfectsxm.com;
• Individuals who request a quote, book a walkthrough or contact us via any form on the site;
• Clients who receive services from us, and the property contacts and household members we interact with in order to deliver those services;
• Owners and managers of properties we maintain, including their authorized representatives;
• Recipients of our transactional or service-related emails (e.g., quote confirmations, scheduling reminders).

It does not apply to third-party services you may use independently (for example, WhatsApp, Google Maps, or your mobile carrier), even if you reach those services from links on our site. Those services have their own privacy policies.

3.1 Information you provide directly

• Identification & contact details: name, email address, phone or WhatsApp number — submitted through our quote form, walkthrough booking widget, contact form or email.
• Property details: address, area, pool type and dimensions, equipment details, surfaces, access notes and gate codes — provided to enable us to scope and deliver services.
• Service preferences: service requested, preferred cadence, preferred walkthrough date and time, free-text notes you choose to share.
• Visit data: chemistry readings (pH, free/total chlorine, alkalinity, CYA, salt, temperature), products applied, technician notes, before/after photos taken at your property during a service.
• Billing data: billing name, billing address, invoice references, payment confirmations. We do not store full payment-card numbers; payments are handled outside the website (bank transfer, cash, or a future payment processor with its own controls).
• Communications: the contents of messages you send us by email, WhatsApp, phone, or via forms on the site.

3.2 Information collected automatically

• Connection metadata: IP address, browser user-agent, referring URL, timestamps and request paths. This is logged at our edge (Cloudflare) for short periods to secure the service and prevent abuse.
• Cookies and similar technologies: we use a small number of strictly necessary cookies and browser-storage items. See our Cookie Policy for details.
• No analytics or advertising tracking: we do not run third-party analytics (such as Google Analytics) on the public marketing site, and we do not run advertising pixels.

3.3 Information from third parties

We do not currently buy or receive personal data about you from third-party data brokers. If a property manager or referrer shares your contact details with us so that we can scope a service, we will treat that information under this policy from the moment we receive it.

3.4 Sensitive categories

We do not deliberately collect sensitive personal data (such as health, religion, racial or ethnic origin, political opinions). Please do not include sensitive information in free-text fields. If you do, we will treat it under this policy and delete it on request.

We do not use your data for automated decision-making with legal or similarly significant effects on you, and we do not profile you for advertising.

We do not sell your personal information. We share it only with the categories of recipient below, and only to the minimum extent necessary:

5.1 Service providers (processors)

We rely on the providers below to host and operate the service. Each acts as a processor on our behalf, bound by contractual confidentiality and security obligations.

5.2 Property managers and authorized representatives

Where a property manager or designated representative engages us on behalf of an owner, we will share service updates, photo reports and chemistry summaries with them as part of the agreed scope.

5.3 Legal and regulatory disclosures

We may disclose personal data where we are required to do so by law, by a competent court of Sint Maarten or another applicable jurisdiction, or where we reasonably believe disclosure is necessary to protect our rights, safety, or property — or those of our clients or others.

5.4 Business transfers

If we reorganize, merge with another business, or transfer assets, your information may be transferred as part of that transaction. We will require any recipient to handle the data consistently with this policy and we will notify you in advance where required by law.

5.5 Aggregated or anonymized information

We may share aggregated, anonymized statistics that do not identify any individual (for example, the number of visits performed in a given month) for operational and marketing purposes.

Sint Maarten is not part of the European Union, and your data may be transferred to and stored in jurisdictions outside Sint Maarten, including the European Union and the United States, by our processors listed in section 5.

Where personal data of individuals located in the European Economic Area is transferred outside the EEA, we rely on appropriate safeguards in accordance with the GDPR, including the European Commission's Standard Contractual Clauses where applicable. We will provide a copy of the relevant safeguard documentation upon reasonable request to privacy@aquaperfectsxm.com.

We keep personal data only as long as necessary for the purposes for which we collected it, including to meet legal, accounting or reporting requirements.

When data is no longer needed, it is either deleted or irreversibly anonymized so it can no longer be linked to you.

Under the National Ordinance on Personal Data Protection of Sint Maarten — and, where applicable, the GDPR — you have the following rights in respect of your personal data:

• Access: request a copy of the personal data we hold about you.
• Rectification: ask us to correct inaccurate or incomplete data.
• Erasure: ask us to delete data we no longer have a lawful basis to keep.
• Restriction: ask us to limit how we use your data while a dispute is resolved.
• Objection: object to processing we carry out under our legitimate interests, including for direct marketing.
• Portability (GDPR): receive a structured, commonly used copy of certain personal data and transmit it to another controller.
• Withdraw consent: where we rely on your consent, you can withdraw it at any time without affecting the lawfulness of earlier processing.
• Complaint: lodge a complaint with the supervisory authority for personal data protection in Sint Maarten or, where applicable, your local EU/EEA data protection authority.

To exercise any of these rights, contact privacy@aquaperfectsxm.com. We will respond within one month of receiving your request, subject to verifying your identity. Where the request is complex or numerous, we may extend that period by up to two months and will tell you why.

We take reasonable and appropriate technical and organizational measures, including:

• Encryption of data in transit (HTTPS/TLS) between your device, our edge and our processors.
• Encryption of data at rest in our managed database and storage buckets.
• Role-based access controls and least-privilege defaults: only authenticated staff and administrators can view client or visit data.
• Database-level security policies (row-level security) so that public endpoints can only write to the limited tables they need.
• An audit log of administrative actions in the back-office.
• Vendor due diligence for processors that handle personal data on our behalf.

No method of transmission or storage is 100% secure. If we become aware of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify you and any competent supervisory authority in accordance with applicable law.

Our services and website are not directed at children. We do not knowingly collect personal data from anyone under the age of 16. If you believe a child has provided us with personal data, please contact privacy@aquaperfectsxm.com and we will delete it.

We send three kinds of email: transactional (quote confirmations, scheduling, invoices), service updates to existing clients, and replies to enquiries you send us.

• You can unsubscribe from non-essential emails at any time by clicking the link at the bottom of any such email, or by emailing privacy@aquaperfectsxm.com.
• We maintain an email suppression list to honour your unsubscribe choice. We retain the minimum data necessary to ensure we do not contact you again.
• Transactional emails directly related to a service you have requested (for example, a quote you asked for) are not subject to unsubscribe and are sent regardless.
• If you contact us on WhatsApp, your messages are handled under WhatsApp's privacy policy in addition to ours.

We may update this Privacy Policy from time to time to reflect changes in law, our services or our practices. We will update the “Effective” date at the top of this page. Where the changes are material, we will take reasonable steps to notify you before they take effect — for example, by an in-app notice or by email to existing clients.
